Gay marriage is now legal in California, but a non-resident who attempts to marry a U.S. citizen may face deportation. Citizenship and Immigration Services spokeswoman Chris Rhatigan: "The couples are married under state laws in California. The federal government does not recognize these marriages for immigration purposes."

Hi Mrjam7: not quite. Since same-sex marriages are only valid in the state of California and immigration laws are federal, gay couples who get married in California still won't have the same rights as straight couples.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
Doesn't this mean if the state recognizes it then the federal government by requirement has to recognize it?

actually drew i think that's the whole issue.
the US constitution allows states to govern themselves and make some of their own rules about things like marriage. and since different states have different rules there is a big mess regarding how to honor vows made in one state in another.
basically until every state in the use allows gays to marry, gay marriage wont truly be equal in the united states.
its a screwed up system but all we've got for now.
